You bought an apartment in Dubai Marina, or you’re about to. Dubai doesn’t charge income tax on your rent, doesn’t tax your gain when you sell, and has no annual property tax. So what does the Belastingdienst have to do with it? Quite a lot, as long as you live in the Netherlands. Box 3 Dubai real estate rules are where many Dutch investors get tripped up, mostly because the internet is full of two opposite myths. One says your Dubai home is fully taxed in the Netherlands. The other says it’s completely tax-free. Neither is right.
This guide walks you through how it really works in 2026, with actual numbers.
If you’re a Dutch tax resident and you own property in Dubai privately, you must declare it in Box 3 of your Dutch income tax return. The Belastingdienst then calculates Box 3 tax over your total wealth, including the Dubai property. After that, the 2009 tax treaty between the Netherlands and the UAE gives you a reduction for the part of your wealth that sits in Dubai.
For someone whose only Box 3 asset is a Dubai apartment, that reduction usually wipes out the Dutch tax on it. For someone who also has savings or investments in the Netherlands, a slice of tax often remains. We’ll show you why below.
Once you genuinely emigrate to the UAE, your Dubai property drops out of Dutch Box 3 altogether.
The Netherlands taxes its residents on their worldwide income and wealth. It doesn’t matter where the asset sits. A second home in Spain, shares in New York and an off-plan unit in Business Bay all count.
A Dubai property falls in Box 3 when you:
Box 3 treats it as “overige bezittingen”, the category that also covers shares, bonds, and a second home in France.
| Item | 2026 |
|---|---|
| Deemed return on savings | 1.28% (provisional) |
| Deemed return on other assets, including Dubai property | 6.00% (final) |
| Deemed return on debts | 2.70% (provisional) |
| Tax-free allowance (heffingsvrij vermogen) | €59,357 per person, €118,714 for tax partners |
| Debt threshold (schuldendrempel) | €3,800 per person, €7,600 for tax partners |
| Box 3 tax rate | 36% |
The 6% on property matters most here. It’s a fixed assumption. The Belastingdienst doesn’t look at whether your apartment actually earned 6% that year. It assumes it did. You can see the official breakdown on the Belastingdienst page on the Box 3 calculation for 2026.
There’s no WOZ value for a Dubai apartment. You report its market value instead: the “waarde in het economisch verkeer” in unoccupied state. For a second home abroad, the Belastingdienst’s guidance links that to the same date logic the WOZ uses, which means the value on 1 January of the year before. So your 2026 return uses the value on 1 January 2025. Check the date the aangifte screen asks for, because it’s what counts.
Good evidence for that value includes:
Dubai prices are in dirhams. Convert to euros at the exchange rate on the valuation date and keep a note of the rate and its source. It sounds fussy, but a clean paper trail is the best defence if the Belastingdienst ever asks questions.
Don’t lowball the value. An understated value can lead to a correction and a penalty. Overstating it costs you money.
Lots of Dutch buyers purchase off-plan and pay in instalments during construction. Before handover, you don’t own a finished apartment. What you own is a contractual right to receive one. In practice, that right is reported in Box 3 at what it’s worth on the valuation date, which is often close to the instalments you’ve already paid.
The instalments you still owe the developer usually aren’t a Box 3 debt, since they’re a future purchase obligation rather than a loan. Whether the treaty reduction applies to an off-plan right the same way it applies to a finished apartment is worth checking with an adviser before you file. Keep your SPA, the Oqood registration and every payment receipt.
For the wider picture on areas, yields and buying steps, see our Dutch-language guide to investing in Dubai property.
A mortgage on your Dubai apartment counts as a Box 3 debt. You don’t get Box 1 mortgage interest relief on a second home, here or abroad.
Two things catch people out. First, only the part of your total Box 3 debts above €3,800 (€7,600 for partners) is deductible. Second, the debt reduces your deemed return at 2.70%, while the property adds 6.00%. So a €100,000 loan doesn’t cancel out €100,000 worth of property in the calculation. The property still produces more deemed income than the loan takes away.
This is where most confusion comes from, so let’s slow down.
The Netherlands and the UAE signed a tax treaty in 2009. Article 6 says income from real estate may be taxed in the country where the property sits. For your apartment, that’s the UAE. Article 22 then says the Netherlands may include that income in its calculation but has to give relief for it, following the Dutch rules on avoiding double taxation.
Under the current Box 3 system, that relief works as a proportional reduction. The Belastingdienst first works out your Box 3 tax on everything. Then it looks at what share of your wealth is in Dubai and knocks that same share off the tax. The fact that the UAE charges nothing doesn’t block the relief.
So the property must be declared, and the treaty then reduces the tax. It isn’t an either/or.
Take Sanne, single, living in Utrecht. On the valuation date, she has €100,000 in a Dutch savings account and a Dubai apartment worth €400,000. No debts.
| Step | Amount |
|---|---|
| Deemed return on savings (€100,000 × 1.28%) | €1,280 |
| Deemed return on the apartment (€400,000 × 6.00%) | €24,000 |
| Total deemed return | €25,280 |
| Total wealth | €500,000 |
| Taxable base after the €59,357 allowance | €440,643 |
| Box 3 income (€25,280 × 440,643 / 500,000) | €22,279 |
| Box 3 tax before treaty relief (36%) | €8,020 |
| Treaty reduction (Dubai = 80% of her wealth) | €6,416 |
| Box 3 tax to pay | €1,604 |
Now compare. With only the €100,000 in savings, Sanne would pay about €187 in Box 3 tax. With the Dubai apartment added, she pays about €1,604. The apartment costs her roughly €1,400 a year in Dutch tax, even though the UAE taxes it at zero and the treaty “exempts” it.
The reason is that the reduction splits the tax by value, but the tax itself was driven mostly by the property’s 6% deemed return. Her savings carry 20% of the value but only a tiny part of the deemed return. Once the reduction is split by value, part of the tax generated by the Dubai apartment ends up on the Dutch side of the split.
If Sanne had owned only the Dubai apartment, the reduction would have been 100%, and her Box 3 bill would have been zero. The more low-yield Dutch savings you hold alongside Dubai property, the bigger this leftover gets.
Treaty calculations like this are exactly where working with a tax consultant in Dubai who also knows Dutch Box 3 pays for itself. Your personal mix of savings, shares, debts and a fiscal partner changes the outcome.
Since the Supreme Court rulings, you can show that your real return was lower than the deemed return. This is the tegenbewijsregeling. If your actual Box 3 return over the year is lower, the Belastingdienst uses the lower figure.
For Dubai property owners, this rarely helps in a good market. Actual return includes rent received and the change in value over the year, even if you didn’t sell. Dubai prices have risen strongly, so the actual return often beats 6%. There’s also no tax-free allowance in the actual-return calculation, and costs such as service charges, maintenance, and management fees aren’t deductible. Only interest on a Box 3 debt is.
Since 2026, there’s something new. If the apartment is available for your own use, say as a holiday home, you must add a benefit for that own use when you calculate actual return. The Belastingdienst lets you use either the economic rental value or a flat 5.06%, pro rata to the days it was available to you. Days it was rented out don’t count.
In short, the actual-return route mostly helps in years when Dubai prices fall.
Normal rental through a property manager or a long-term tenant keeps your apartment in Box 3. The rent isn’t taxed separately in the Netherlands.
It changes if your activities go well beyond managing an investment. If you run a hotel-style short-let operation yourself with cleaning, check-ins, and extra services, the income can move to Box 1 as “resultaat uit overige werkzaamheden” or even business profit. Most Dutch owners hand short-lets to a licensed holiday home operator in Dubai. That keeps the Box 3 treatment far simpler.
Owning through a company swaps the Box 3 regime for a different set of rules.
With a Dutch BV, the property is no longer in your Box 3. The BV deals with Dutch corporate tax rules for foreign real estate, and you pay Box 2 tax when you take money out.
With a UAE company, the property sits inside a UAE entity that files for UAE corporate tax. You then hold shares in that company from the Netherlands. If you own 5% or more, those shares fall in Box 2. Below that, they’re a Box 3 asset. Dutch rules on foreign low-taxed companies can also come into play.
Neither route is automatically cheaper. It depends on your size, your plans, and whether you’ll stay in the Netherlands. If a company does make sense, our team handles Dubai company setup from licence to bank account. Once it’s running, proper accounting and bookkeeping keep both the UAE and Dutch sides consistent.

Once you’re no longer a Dutch tax resident, the Netherlands stops taxing your worldwide wealth. Your Dubai apartment then falls outside Dutch Box 3 completely.
A few things to keep in mind:

Many of our clients combine the move with a new company, which is why we often cover property, residency and running a Dutch business from Dubai in the same conversation.
The UAE side is refreshingly short:
There’s also a residency angle. A property worth AED 2 million or more can qualify you for a ten-year Golden Visa, and lower amounts can support a shorter investor visa. The Dubai Land Department processes the investor route. We explain the options in our guide to the residence visa in Dubai, and our PRO services take care of the Emirates ID and the government paperwork.
A Golden Visa is a residency permit, though. It doesn’t move your tax residence out of the Netherlands.
The Wet werkelijk rendement box 3 would replace deemed returns with actual returns. For real estate, rent and other direct income would be taxed every year, and value growth only when you sell. The Tweede Kamer passed it on 12 February 2026.
The Eerste Kamer then postponed its vote until the government sent an amendment, due on Prinsjesdag 2026. That amendment didn’t come. On 15 September 2026, the government said it couldn’t agree on how to fund the changes and moved the decision to the Voorjaarsnota 2027. That puts the planned start date of 1 January 2028 under real pressure. You can follow the progress on the Eerste Kamer page for bill 36748.
The bill also changes how foreign relief works. The value-based proportional reduction would be replaced by allocating income directly per source. Several advisers expect that to give fuller relief for UAE property, since the Dubai income would be attributed to Dubai directly. Others are more cautious. Until the final text is law, treat any 2028 forecast as a scenario, not a plan.
This one isn’t theoretical. Leaked data from the Dubai Land Department linked 1,051 Dutch people to 1,721 properties in Dubai. The Belastingdienst has used it to send formal information requests under Article 47 AWR, and it’s specifically interested in how the purchases were financed.
If you’ve never reported a Dubai property, fix it before a letter arrives. A voluntary correction almost always ends better than a correction after the Belastingdienst finds it. Penalties on hidden foreign assets can run higher than the tax itself. And because of the treaty reduction, the extra tax is often smaller than people fear.
Keep these together every year:

Do I have to declare my Dubai property to the Belastingdienst?
Yes, if you’re a Dutch tax resident and own it privately. It goes in Box 3 as “other assets”, even though the UAE doesn’t tax it.
Is Dubai real estate tax-free for Dutch residents?
Not automatically. The NL-UAE tax treaty gives a proportional reduction of your Box 3 tax. If you also hold Dutch savings or investments, some Dutch tax on the Dubai property usually remains.
Which value do I use for my Dubai apartment?
The market value in an unoccupied state. For a second home abroad, the Belastingdienst links this to 1 January of the year before the tax year. Convert AED to euros at the rate on that date.
Can I deduct my Dubai mortgage?
Yes, as a Box 3 debt, above the €3,800 threshold per person. It reduces your deemed return at 2.70%, while the property adds 6.00%.
How do I report an off-plan purchase?
You report the value of your contractual right, which is often close to the instalments paid so far. Instalments you still owe usually aren’t a Box 3 debt. Ask an adviser how treaty relief applies before you file.
Does a Golden Visa end my Dutch tax obligations?
No. A Golden Visa is a residency permit. Dutch tax residence depends on where your life actually takes place.
What happens to my Dubai property if I emigrate?
After real emigration, it leaves Dutch Box 3. Dutch property you keep stays taxable, and Dutch nationals remain subject to Dutch inheritance tax for ten years.
Will the new Box 3 law start in 2028?
It’s uncertain. After Prinsjesdag 2026, the government postponed its amendment to the Voorjaarsnota 2027, and the Eerste Kamer hasn’t voted yet.
The Belastingdienst doesn’t care that Dubai charges you nothing. It cares whether your return tells the full story, and a well-documented Dubai property usually costs far less than the rumours suggest.
